Acceptance

These Terms of Use ("Terms") govern your use of https://afterpayshopping.com (the "Site"), operated by APS Digital Media LLC ("we", "us"). By using the Site or submitting a loan request you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

Sample terms. Have counsel review this page for your entity, your lending-network agreement and the states you serve before launch.

What the Site is

The Site publishes independent educational content about Afterpay and other buy-now-pay-later services, and offers a free form through which you may request to be connected with third-party lenders for personal loans of $200–$5,000. Content is for general information only and is not financial, legal or tax advice. We are not affiliated with Afterpay, Cash App or Block, Inc.

Not a lender

We are not a lender, broker, agent or representative of any lender, and we do not make credit decisions, originate loans, set rates or terms, or collect payments. Submitting a request does not guarantee that you will be connected with a lender or receive an offer. Any loan is a contract between you and the lender, governed by the lender's agreement and applicable law. APRs typically range from 5.99% to 35.99% with terms of 3–36 months; the lender determines your actual terms. Representative example: $2,000 over 24 months at 24% APR = 24 payments of $105.72, total $2,537.28. Loans are not available in all states.

Eligibility

You must be at least 18 years old, a US resident, and able to form a binding contract to use the loan form. You agree to provide accurate, current and complete information and to update it as needed. You may not use the Site for any unlawful purpose, submit information about anyone other than yourself without authority, or attempt to interfere with the Site's operation.

Information accuracy

We work hard to keep Afterpay fees, limits, store lists and competitor terms accurate and show a review date on each page, but these change frequently and without notice. We make no warranty that any figure is current. Always confirm terms with Afterpay at checkout, in the app, or with the lender before you sign anything.

Intellectual property

The Site's text, graphics, logos and code are owned by APS Digital Media LLC or its licensors and protected by copyright and trademark law. You may link to and quote brief excerpts with attribution; you may not reproduce substantial parts, scrape, frame or commercially redistribute content without written permission. Third-party names and marks (Afterpay, Cash App, Klarna, Affirm, PayPal, Zip, and retailers) belong to their owners.

Disclaimers & liability

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, APS DIGITAL MEDIA LLC AND ITS OFFICERS, EMPLOYEES AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY LOAN OR SERVICE OBTAINED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED $100. Some states do not allow these limitations, so they may not apply to you.

You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or misuse of the Site.

Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally within 30 days of written notice shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. You and we waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by emailing [email protected] within 30 days of first using the Site.

General

If any provision is held unenforceable, the rest remains in effect. These Terms, with the Privacy Policy, are the entire agreement between you and us regarding the Site. We may change these Terms by posting a revised version with a new effective date; continued use means acceptance.
